Terms of Service

Please read these Terms carefully before downloading, using, or accessing the Permitly application. By creating an account or using Permitly you agree to be bound by these Terms. If you do not agree, do not use the App.

These Terms of Service (the "Terms") are a binding agreement governing your use of the Permitly mobile application and related services (together, the "Service"), owned and operated by Money Lat SpA ("Money Lat", "we", "us", or "our"), a company established in Chile. "You" means the person accessing or using the Service.

1. What Permitly Is — and What It Is Not

Permitly is a study application that helps you prepare for the written knowledge test required for a United States learner's permit or driver licence. It covers car (Class C), motorcycle (Class M) and commercial (CDL) licences, and provides lessons, practice questions, exam simulations, progress tracking and an in-app AI study assistant (the "Teacher"), tailored to the licence type and U.S. state you select.

Permitly is an independent study aid. It is not affiliated with, endorsed by, or connected to any Department of Motor Vehicles (DMV, BMV, MVA, DOS, RMV), the FMCSA, NHTSA, or any other government agency in the United States or elsewhere. We do not issue permits or licences, we cannot schedule, administer or influence your official test, and passing practice tests in the App does not guarantee that you will pass the real examination.

Permitly does not provide legal advice. Traffic law varies by state and changes over time. Our content is prepared with care from official state driver handbooks and agency sources, but it may contain errors, may become outdated, and is no substitute for your official state driver handbook or the instructions given to you by your licensing agency. Always confirm anything decisive — test format, fees, required documents, eligibility ages and appointment rules — with your own state's licensing agency before acting on it. You are responsible for how you drive and for complying with the traffic law that applies to you.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your place of residence (typically 18), you may only use the Service under the supervision of, and with the consent of, a parent or legal guardian who agrees to be bound by these Terms on your behalf and who is responsible for your use of the Service, including any purchases. We ask that children under 13 do not use the Service. We may terminate or refuse access if we discover that you do not meet these requirements or that information you provided is inaccurate.

3. Your Account

To save your progress you must sign in with your Apple or Google account. Permitly does not use passwords. You are responsible for all activity under your account and for keeping access to your sign-in credentials and your device secure. Accounts are personal: you may not share, sell, or transfer your account, and you may not use another person's account.

You agree that the information you give during onboarding — including your state and licence type — is accurate, since the course you receive is built from it.

You may delete your account at any time, from inside the App: the You tab → AccountDelete account. Deletion is permanent and removes your profile and all study progress. If you cannot access the App, email support@permitly.app and we will complete the deletion within 30 days. See the Privacy Policy for details.

4. Subscriptions, Billing and Cancellation

Permitly is offered as an auto-renewing subscription. Some parts of the App are available without a subscription; full access to the lessons, question bank, exam simulations and the Teacher requires an active subscription.

Prices and billing periods

Automatic renewal

Your subscription renews automatically. It renews for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within the 24 hours before the current period ends.

Managing and cancelling

You can manage or cancel your subscription at any time in your store account — you do not need to contact us:

Cancelling stops future renewals; you keep access until the end of the period you have already paid for. Deleting the App or deleting your Permitly account does not cancel your subscription — you must cancel it in the store account that is being billed.

Price changes

We may change subscription prices. Where a change affects your existing subscription, Apple or Google will notify you in advance and, where required, ask for your consent before the new price takes effect; if you do not agree, you may cancel before the next renewal.

Restoring purchases

A subscription belongs to the Apple or Google account that bought it, not to your Permitly account. Use Restore purchases in the You tab after a reinstall or on a new device. To prevent subscription sharing, we limit how many different Permitly accounts may claim the same subscription over its lifetime.

5. Refunds and Right of Withdrawal

Purchases are processed by Apple or Google, and refunds are handled by them under their own policies — Money Lat cannot issue, approve or deny a store refund.

Except where the law requires otherwise, payments are non-refundable and there is no refund of a partially used period. If you request a refund, the store may ask us to confirm your usage of the App, and we may share the minimum activity information needed to review the request fairly.

If you are a consumer in the European Union, the United Kingdom, or another jurisdiction granting a statutory withdrawal ("cooling-off") period for digital content, you acknowledge and expressly request that access to the Service begins immediately upon purchase, and you accept that you thereby lose your right of withdrawal once access has been provided. This does not affect any mandatory statutory right you have that cannot be waived.

6. The AI Teacher

The Teacher is an AI assistant that answers questions about road rules, signs, procedures and exam strategy. It is generated by a large language model and grounded, where possible, in official sources and in your own course material.

AI answers can be wrong. The Teacher may produce inaccurate, incomplete or outdated information, including about rules, fees, ages, limits and penalties that differ by state and change over time. Treat its answers as study guidance only, verify anything important against your official state driver handbook, and never rely on it as legal advice or as a substitute for your licensing agency's instructions.

8. Intellectual Property and Licence

Money Lat retains all rights, title and interest in the Service, including the App, its software, design, user interface, lessons, question bank, explanations, illustrations and trademarks. Certain underlying facts and rules originate in official state driver handbooks and government sources which are not owned by us; our compilation, wording, structure and presentation of them are.

We grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the App on devices you own or control, for your own non-commercial study. All rights not expressly granted are reserved. You may not remove any proprietary notice.

If you send us feedback, ideas or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them without obligation or compensation to you.

9. Third-Party Services

The Service depends on third parties to function, including Apple, Google, Google Firebase, the Google Gemini API and Superwall. Your use of the Service is subject to those third parties' own terms and privacy policies. Money Lat makes no warranties regarding, and is not liable for, the acts or omissions of any third-party provider. The Teacher may link to official agency websites; we do not control those sites and are not responsible for their content.

10. Availability and Changes to the Service

We may add, modify, suspend or discontinue features of the Service at any time, and we update content as state rules change. Where a change would materially reduce the core functionality you have paid for, we will give reasonable notice, and you may cancel your subscription as described in Section 4. Some features require an internet connection.

You agree to indemnify, defend and hold harmless Money Lat and its affiliates, officers, employees and agents from any claims, liabilities, damages, losses and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service; (b) your violation of these Terms or any applicable law; or (c) your violation of the rights of any other person. This obligation survives termination of these Terms.

You may terminate these Terms at any time by cancelling your subscription, deleting your account and uninstalling the App. We may suspend or terminate your access, with or without notice, if you violate these Terms, misuse the Service or engage in unlawful conduct. If we terminate your access without cause, we will refund the unused portion of your current subscription period where the law requires it. Provisions that by their nature should survive termination will survive.

15. Changes to These Terms

We may modify these Terms by posting the updated version and revising the "Last updated" date above. If the changes are material, we will give notice within the App or by email before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms; if you do not accept them, you must stop using the Service and cancel your subscription.

16. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Chile, where Money Lat SpA is established, without regard to conflict-of-law rules, and subject to any mandatory consumer-protection rights you have in your country of residence. You agree to first attempt to resolve any dispute with us informally by contacting support@permitly.app before initiating any formal proceeding, and to allow at least thirty (30) days for us to respond. Nothing in these Terms limits mandatory legal rights that cannot be waived under the law of your residence, nor deprives a consumer of the protection of the mandatory rules of the country in which they reside.

Where permitted by applicable law, any dispute not resolved informally shall be submitted to the competent courts of Santiago, Chile. This clause does not override any right you may have to bring proceedings in the courts of your own country of residence where such right is guaranteed by mandatory local law.

17. App Store, Google Play & Platform Terms

The App is made available through the Apple App Store and Google Play. The following terms apply to your download and use of the App from those platforms. Where these Terms conflict with the applicable platform's rules, the platform's rules control for the purpose of your use of that platform.

If you obtained the App from the Apple App Store, the following additional terms apply and are required by Apple:

If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App, its content, or any subscription sold through it. Payments, renewals and refunds are handled by Google under Google Play's policies.

You agree to comply with all applicable third-party terms (for example, your wireless data services agreement) when using the App, and with the usage rules of the platform from which you obtained the App.

18. Miscellaneous

These Terms, together with the Privacy Policy, form the entire agreement between you and Money Lat regarding the Service. If any provision is held unenforceable, the remainder continues in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition or sale of assets. Nothing in these Terms creates a partnership, agency or employment relationship between us.
